The Register reports that Benjamin Cohen is to seek judicial review of the decision of Nominet (the .co.uk registrar) to order him to hand over his company CybergroupBritain's itunes.co.uk domain name to Apple. Cohen registered "itunes.co.uk" on 7 November 2000, some three years before Apple registered the name "itunes.com" through which it sells online access to music. Cohen denies he was cybersquatting and insists that his use of the itunes.co.uk site was legitimate.

The IPKat says that the judicial review should be welcomed. Either it will give Nominet a clean bill of health, in which case confidence in its dispute resolution procedures will be boosted, or it will pinpoint deficiencies that must be firmly addressed. Merpel wonders if, commercially, the battle is really worth Apple fighting. How many people looking to load up an iPod would stray as far as itunes.co.uk?
