Latest Trademark World

"Not seeing the wood for the trees" is the caption on the cover of the March 2007 issue of near-monthly Trademark World. It's nothing to do with tree-related trade marks, though - it's a review by IPKat co-bloggie Jeremy's old colleague Rajita Sharma and trainee Sarah Hallahane (Reed Smith Rambaud Charot) of the controversial interface of IP and competition law over parallel imports, drawing the conclusion that the balance of power may lie with rights owners over the importers. Other features in this busy pre-INTA issue include
* yet another good piece by John A. Tessensohn (Shusaku Tamamoto, Japan), this time on some recent and much-welcomed legislative tidying-up of Japanese trade mark and designs law;

* a review by Jenni Rutter and David Parrish (Baker & McKenzie) of the painful prospects for European IP owners after the ECJ rulings in Class International and Montex that require goods to be put on the market before you can seize them;

* Brand Enforcement's Lisa Lovell on how to teach the public that, where IP rights are concerned, there's no such thing as a victimless crime.
